Terms of Use
The agreement between you and YouInspect™. Please read it — especially the parts about what YouInspect is not, your safety, and the limits of our responsibility.
Effective August 5, 2026 · Patent Pending
1. Agreement to these Terms
These Terms of Use ("Terms") are a legal agreement between you and YouInspect™, based in Bastrop, Texas ("YouInspect," "we," "us," or "our"). They govern your access to and use of the YouInspect app, website, and related services (together, the "Service").
By creating an account, checking a box that references these Terms, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
2. Who may use YouInspect
You must be at least 18 years old and able to form a binding contract to use the Service. You agree to use it only for lawful purposes and only to help you pre-screen and document a property you own, are buying, or are otherwise authorized to inspect.
The Service is not directed to children, and we do not knowingly allow anyone under 18 to create an account.
3. What YouInspect is — and is not
YouInspect is a guided, do-it-yourself visual pre-screening and documentation tool. It helps you walk a property, record what you can see, take photos and notes, and understand what questions to ask a professional next.
YouInspect is buyer education and pre-screening. It is NOT a licensed home inspection, and it is NOT a substitute for one. It does not provide a professional, licensed, or certified opinion about a property, and it does not decide whether a home is safe, sound, code-compliant, or free of defects.
You should always hire a qualified, licensed home inspector — and other licensed professionals as needed — before purchasing or relying on the condition of a property. YouInspect does not replace them.
When you mark an item "Pass," you are recording your own visual impression that day — not a professional determination. A "Pass" in YouInspect never means a system is safe, code-compliant, or defect-free, and it never replaces a licensed professional, especially for major systems like the foundation, roof, structure, electrical, plumbing, and gas.
4. No professional advice; no reliance
All information provided through the Service — including checklists, tips, reference material, and any automated or AI-assisted observations or suggestions — is for general educational and informational purposes only. It does not constitute a certified inspection report or professional advice, and it may be incomplete or incorrect.
Automated observations are suggestions only. They can miss problems and can flag things that are not problems. You are responsible for the observations you record and for the decisions you make. Do not rely on the Service as the basis for buying, selling, financing, or valuing a property, or for judging whether any condition is safe — consult the appropriate licensed professional.
5. Your safety and assumption of risk
Your safety is your responsibility. A property inspection can expose you to serious hazards — including falls from height, unstable or slippery surfaces, electrical shock or electrocution, gas, and confined spaces — that can cause serious injury or death. You perform the inspection yourself, and you do so entirely at your own risk.
YouInspect is a software tool. It does not perform the inspection, it is not present with you, and it does not control the property or your actions — only you decide what you physically do. YouInspect is telling you now, clearly: do the dangerous things below only through a licensed professional, never yourself.
Observe only from a stable, finished floor or a safe ground-level position. You agree that you will NOT:
- use a ladder, or climb, step, or go onto a roof — look at the roof only from the ground;
- enter an attic, crawl space, or any confined, elevated, or unstable space, or put your head or body into one — observe only from the access opening;
- touch, open, reach into, or place any part of your body on or into an electrical panel, main panel, sub panel, breaker, meter, outlet, wiring, or any live or energized part — a live wire can shock, burn, or kill you, so keep panel covers on and look only;
- test for, or try to find, a gas or propane leak, or operate any equipment in an unsafe way — if you smell gas, leave and call a professional; or
- enter any area, or take any action, that is unsafe or that you are not authorized, trained, or qualified to perform.
If a check cannot be done safely from a stable, ground-level or finished-floor position, do not attempt it — mark it Not Inspected and ask a licensed professional. You are responsible for obtaining permission to enter and photograph any property, and for complying with all applicable laws while doing so.
6. Your account
Some features may require an account. Certain account, cloud-sync, and payment features may be offered in preview or may not yet be available, and are provided on an “as available” basis. When they are available, you agree to provide accurate information, to keep your credentials secure, and to be responsible for activity under your account. Tell us promptly if you suspect unauthorized use.
7. Your content
You keep ownership of the property records, photos, notes, and other content you create (“Your Content”). You grant YouInspect a limited, non-exclusive license to store, process, reproduce, and display Your Content solely to operate and provide the Service to you (for example, to save your inspection, generate your report, and, if you turn it on, sync or share it).
You are responsible for Your Content and represent that you have the rights and permissions needed to create it, including any permission required to photograph a property. Do not upload content that is unlawful, infringing, or that you do not have the right to share.
8. Acceptable use
You agree not to:
- use the Service for any unlawful purpose, or on a property you are not authorized to inspect;
- present a YouInspect report as a licensed or certified professional inspection;
- copy, scrape, reverse engineer, or attempt to extract the Service's source code, content library, or taxonomy, except as allowed by law;
- interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service or others' data; or
- misuse, resell, or commercially exploit the Service without our written permission.
9. Payments
Some features (such as unlocking a full or single-item report) require a one-time payment, processed securely by our third-party payment processor. Applicable prices, taxes, and any refund terms are presented to you before you buy, and your purchase is subject to those posted terms. Prices may change. A purchase unlocks a one-time report; it is not a subscription and does not auto-renew.
10. Third-party services and referrals
The Service may link to, or help you connect with, third parties — for example, a referral or “Find a Pro” feature that suggests trades or professionals. Those third parties are independent, and any dealings you have with them are solely between you and them. YouInspect does not endorse, employ, supervise, or guarantee any third party, their availability, or their work, and is not responsible for them.
11. Intellectual property
The Service, including the YouInspect™ name and logo, the app, its content, checklists, reference library, and taxonomy, is owned by YouInspect and its licensors and is protected by intellectual-property laws. The Service is Patent Pending — one or more patent applications covering aspects of the Service are on file with the United States Patent and Trademark Office. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own property pre-screening. All rights not expressly granted are reserved.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, YOUINSPECT DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE OR ITS OBSERVATIONS ARE ACCURATE, COMPLETE, RELIABLE, SECURE, OR UNINTERRUPTED. YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE SERVICE AND ANY RELIANCE ON IT.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, YOUINSPECT AND ITS FOUNDER, OWNERS, EMPLOYEES, DEVELOPERS, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, FOR ANY PERSONAL INJURY, BODILY INJURY, OR DEATH, FOR ANY DAMAGE TO OR LOSS OF PROPERTY, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR ANY COST OF REPAIRS OR PROPERTY CONDITIONS THE SERVICE DID NOT IDENTIFY, ARISING OUT OF OR RELATING TO A PROPERTY INSPECTION YOU PERFORM OR YOUR USE OF THE SERVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF YOUINSPECT AND THOSE PARTIES FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID YOUINSPECT IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
14. Indemnification
You agree to indemnify and hold harmless YouInspect and its founder, owners, employees, developers, contractors, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) — including any claim of personal injury, bodily injury, death, or property damage to you or anyone else — arising out of or related to your use of the Service, Your Content, your access to or inspection of any property, or your violation of these Terms, applicable law, or the rights of any third party.
15. Release and waiver of liability
Because you perform the inspection yourself and entirely at your own risk, you agree to the following release. Please read it carefully — it affects your legal rights.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE YOUINSPECT AND ITS FOUNDER, OWNERS, EMPLOYEES, DEVELOPERS, CONTRACTORS, AND AFFILIATES (THE "RELEASED PARTIES") FROM AND FOR ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, LIABILITIES, LOSSES, AND DAMAGES OF EVERY KIND — INCLUDING PERSONAL INJURY, BODILY INJURY, ILLNESS, DISABILITY, DEATH, AND DAMAGE TO OR LOSS OF PROPERTY — ARISING OUT OF OR RELATING TO ANY PROPERTY INSPECTION YOU PERFORM, YOUR PRESENCE AT OR ACCESS TO ANY PROPERTY, OR YOUR USE OF THE SERVICE, EVEN IF CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, TO THE MAXIMUM EXTENT ALLOWED BY LAW.
You expressly assume all risk of injury, death, and property damage from your inspection activities. You specifically acknowledge that YouInspect has told you NOT to climb onto or walk on a roof, use a ladder, enter an attic or crawl space, or touch or reach into an electrical panel, main panel, or any live wire or energized component (see Section 5). If you choose to do any of these things anyway, you do so entirely on your own, against YouInspect's instructions, and at your own risk.
If you are not willing and able to accept these risks, do not perform the inspection yourself — hire a qualified, licensed professional. This release does not apply to any liability that cannot be waived or released under applicable law, and if any part of it is held unenforceable, the remainder stays in effect.
16. Termination
You may stop using the Service at any time. We may suspend or end your access to the Service, in whole or in part, at any time, including if you violate these Terms or to protect the Service or others. Sections that by their nature should survive — including content ownership, disclaimers, limitation of liability, and indemnification — survive termination.
17. Changes to the Service and these Terms
We are actively developing YouInspect and may change, add, or remove features. We may also update these Terms from time to time. If we make material changes, we will take reasonable steps to let you know (for example, by updating the date above or notifying you in the app). Your continued use of the Service after changes take effect means you accept the updated Terms.
18. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at legal@youinspect.app so we can try to resolve it informally.
If a dispute cannot be resolved informally, you and YouInspect agree that it will be brought exclusively in the state or federal courts located in Texas, and each party consents to the personal jurisdiction of those courts and waives any objection to venue there.
19. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and YouInspect regarding the Service.
